Acceptance of Terms
Welcome to the Kosius Group, LLC d/b/a Kosius Health ("Kosius Health," "we," "our," or "us") website and telehealth platform (the "Site"). Accessing or using the Site means you agree to these Terms. If you do not agree, do not use the Site. We may update these Terms, and continued use after an update constitutes acceptance of the revised Terms.
No Physician-Patient Relationship; Limitations of Care
Merely visiting or using this Site does not establish a physician-patient or provider-patient relationship with Kosius Health, Dr. Shivani Anumolu, or any affiliated healthcare provider.
A provider-patient relationship is not created until you complete required intake through the EHR platform, a licensed provider determines telehealth is clinically appropriate, and a consultation is scheduled and conducted under applicable Georgia law.
Site information is for general informational purposes and is not medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay seeking it because of Site content.
Kosius provides telehealth services only to patients physically located in Georgia at the time of consultation. Telehealth has limitations, including the inability to perform a physical examination, potential technical interruptions, diagnostic limitations, and the possibility that in-person evaluation is necessary. Kosius does not provide emergency services. If you have a medical emergency, call 911 or go to the nearest emergency room.
Eligibility and Geographic Limitation
Use of telehealth services is limited to individuals age 18 or older, except where a parent or legal guardian accepts applicable terms and provides required consent for a minor. By scheduling or participating, you represent that you are physically present in Georgia and agree to provide truthful location attestation. False attestation is grounds for termination of services.
Scope of Services; Self-Pay Model
Kosius operates on a self-pay basis and does not bill Medicare, Medicaid, private insurance, or other insurance programs. You agree to pay rates in effect at the time of service. Single-issue consultations are $50 and multi-issue consultations are $99. Visit type is determined by the provider based on scope and clinical complexity, not patient selection.
Payment, Cancellation, and Rescheduling
Payment is due upon completion of the consultation regardless of whether a prescription or specific treatment is ordered. If a prescription is issued, it will not be transmitted until consultation payment is received in full.
Cancellation and no-show policy: A $50 fee will be charged for cancellation or no-show within 24 hours of a scheduled appointment. Rescheduling is permitted at no charge when notice is provided more than 24 hours before the appointment. Same-day rescheduling is not permitted.
To cancel or reschedule, current patients should use the secure Practice Better patient portal or contact support@kosius.com. Appointments cannot be booked by phone or email.
Follow-Up Care and Prescription Refills
After an initial consultation, patients may request follow-up care or prescription refills through the patient portal. The provider will review each request. If no additional live consultation is required, the request will be billed based on scope of care. If further evaluation is required, a new consultation and applicable fee will be required.
Products and Future eCommerce
Kosius may in the future offer dietary supplements or wellness products through the Site or affiliated platforms. Products will be offered for general wellness or nutritional support and are not intended to diagnose, treat, cure, or prevent disease. A separate Purchase Agreement, pricing, shipping, return, refund, and regulatory terms will be presented before any eCommerce launch.
Pharmacy and Compounding Disclosures
Kosius may work with partner pharmacies, including compounding pharmacies, where clinically appropriate. Compounded medications are not FDA-approved drug products or generic equivalents of FDA-approved medications and are not subject to the same pre-market review. Kosius does not receive remuneration from a pharmacy in exchange for referrals.
HIPAA and Privacy
Kosius is a covered entity subject to HIPAA. PHI is collected, used, and disclosed as described in our Notice of Privacy Practices and Privacy Policy, incorporated into these Terms by reference. The Site may also collect non-PHI information through standard website technologies as described in that Policy.
Intellectual Property and Prohibited Uses
Site content, including text, graphics, logos, and software, belongs to Kosius Group, LLC or its content providers and is protected by applicable intellectual-property laws. Materials may be accessed and printed for personal, non-commercial use only. You may not use the Site unlawfully, interfere with its operation, gain unauthorized access, transmit malicious code, scrape or mine data, impersonate another person, or otherwise violate applicable law.
Disclaimer of Warranties
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied. Kosius disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement, and does not warrant uninterrupted, error-free, or virus-free operation.
Limitation of Liability and Indemnification
To the maximum extent permitted by law, Kosius is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or described services. Your sole remedy for dissatisfaction with the Site is to discontinue use.
You agree to defend, indemnify, and hold harmless Kosius Group, LLC and its officers, employees, contractors, and agents from claims, liabilities, losses, and expenses arising from your use of the Site, violation of these Terms, or violation of law.
Governing Law and Changes
These Terms are governed by Georgia law. Disputes will be resolved in state or federal courts located in Coweta County, Georgia, and you consent to those courts' exclusive jurisdiction. Updated Terms will be posted with a revised effective date, and continued use constitutes acceptance.
